What is real estate fraud?

Real estate fraud involves any real estate transaction in which a false representation is made, along with intent to deceive.  Mortgage fraud includes schemes that are designed to defraud a bank or other lending institution.  Some examples of real estate or mortgage fraud are:

• Selling real estate to a straw buyer.  A straw buyer is one whose credit and identity is used in the transaction, instead of the person who will actually be taking possession of the property when the transaction is completed.  This is done on behalf of a buyer who may otherwise not have qualified for the loan.
• Obtaining loans with false identities or information.
• Transfer of title for the purpose of inflating the value of the property.  The straw buyer purchases the property on behalf of an investor.  It is subsequently bought and sold several more times at higher prices to inflate the property's value.  These schemes involve dishonest appraisers, title companies and other interested parties.
